you, in regards to your use of this Site. With respect to your use of

and all prior contemporary agreements, representations, warranties and
understandings are specifically disclaimed. These terms and
conditions may be modified or adjusted at any time by
LiquidationTime.com without further notice to you. The most recent
terms and conditions will be posted on the Site. We encourage you to
read and review this agreement before becoming a member.

Editing, Deleting and
Modification

LiquidationTime reserves the right, in our sole
discretion, to edit, delete or modify any documents, information or
other content appearing on this site at any time.

Eligibility and
registration

You must be 18

LiquidationTime.com. By registering for LiquidationTime.com, you
signify and warrant that you are at least 18 years of age or older and
that you have the capacity to understand, agree to, and comply with
these Terms & Conditions..
To become a
LiquidationTime member, you must provide true, accurate, and complete
registration information.. As part of the registration process, you
will be asked to select a username and password. You will be
responsible for the security of your password and all other activities
occurring under your username. We reserve the right to refuse
to grant a username that may be vulgar, offensive, inappropriate(as
determined by us in our sole discretion), protected by a trademark
proprietary rights law or may duplicate an existing one.
You may not,
under any circumstances, register or make bids under a false name or
use an invalid or unauthorized credit card. You may not impersonate any
participant, nor use another participant's password(s) for any reason.
Such fraudulent conduct is a violation of federal and state laws.
Fraudulent conduct will be reported to law enforcement authorities and
LiquidationTime will cooperate to ensure that violators are prosecuted
to the fullest extent.
As permitted by
applicable law and consistent with our privacy policy, LiquidationTime
has the right, but not the obligation, to monitor any activity and
content associated with this Site. LiquidationTime may investigate any
reported violation of its policies or complaints and take any action
that it deems appropriate in this agreement. Such action may include,
but is not limited to, issuing warnings, suspension or termination of
service, denying access and/or removal of any materials on the Site
which may include listings and bids. LiquidationTime reserves the right
and has absolute discretion to remove, screen, or edit any content that
violates it’s provisions or may be otherwise objectionable.
Usernames shall not contain any advertisement(s) or link(s) to any
websites. Any username that is in violation of this code will
be suspended and/or removed. Direct contact between buyers
and sellers is not permissible. Any attempt to make contact
with either party will result in direct violation of the policies
stated by LiquidationTime.

Appropriate conduct and
content
|
You may not use
(LiquidationTime.com) services for any illegal or unauthorized purpose.
International users agree to comply with all local rules regarding
online conduct and acceptable content, including laws regulating the
export of data from the United States or your country of residence. You
are solely responsible for your conduct and any data, text,
information, graphics, photos, profiles, audio and video clips, links,
and other content that you submit, post, and display on
(LiquidationTime.com) website.
We
may, but shall have no obligation to, remove Materials that we
determine in our sole discretion are unlawful, fraudulent, threatening,
libelous, defamatory, obscene or otherwise objectionable, or infringes
or violates any party's intellectual property or other proprietary
rights or these Terms of User Agreement.
By submitting,
posting or displaying any Materials on or through
(LiquidationTime.com), you automatically grant to us
(LiquidationTime.com) a worldwide, non-exclusive, sublicense able,
transferable, royalty-free, perpetual, irrevocable right to copy,
distribute, and create derivative works of, publicly perform and
display such Materials. That said, our use of your personal information
is governed by our Privacy Policy and we will never rent, sell or share
your personal information with any third party for marketing purposes
without your expressed permission.

and its affiliates and licensors own and retain all rights in the
(LiquidationTime.com) web site and services, which contain proprietary
and confidential information that is protected by applicable
intellectual property and other laws. Except as expressly authorized by
(LiquidationTime.com), you may not copy, modify, publish, transmit,
distribute, perform, display or sell any of (LiquidationTime.com)
proprietary information.
It is our
policy to respond to notices of alleged infringement that comply with
the Digital Millennium Copyright Act.
(LiquidationTime.com) and its affiliates, licensors, partners,
suppliers, consultants, and agents disclaim any and all responsibility
or liability for the accuracy, content, completeness, legality,
reliability, operability or availability of information or materials
displayed on the (LiquidationTime.com) website. (LiquidationTime.com)
disclaims any and all responsibility and liability for the conduct of
any Member.
All materials,
information (including, without limitation, any information or
materials obtained or accessed through (LiquidationTime.com), products
and services included therein are provided "AS IS," with no warranties
whatsoever . (LiquidationTime.com) expressly disclaims to the
fullest extent permitted by law all express, Implied and statutory
warranties, including, without limitation, the warranties of
merchantability, fitness for a particular purpose, and non-infringement
of proprietary rights.
You agree that
your use of ( LiquidationTime.com )service is entirely at your own risk.

No Agency; Third-Party
Beneficiary.

LiquidationTime is not the agent, fiduciary, trustee or other
representative of you. Nothing expressed or mentioned in or implied
from this Agreement is intended or shall be construed to give to any
person other than the parties hereto any legal or equitable right,
remedy or claim under or in respect to this Agreement. This Agreement
and all of the representations, warranties, covenants, conditions, and
provisions herein are intended to be and are for the sole and exclusive
benefit of LiquidationTime, its Certified Merchants and you.
Successful bidders agree that (LiquidationTime.com) may, at their sole
discretion whatever method it deems appropriate for shipping and
delivery.
Any member/user
is responsible for providing accurate shipping address information.
Providing inaccurate information will result in the assessment of
additional shipping fees to the party or parties providing the wrong
information. In case of any mistakes by a buyer listing an incorrect or
faulty shipping address, all charges will be on the buyer and the buyer
cannot hold LiquidationTime.com responsible for the inconvenience of
shipping merchandise to an incorrect address. Note, the buyer will have
to pay for all shipping-cost in this case.
If agreed or
previously promised by (LiquidationTime.com), any product or services
are to be delivered to the buyer depending on location (4-15 days)
starting from the hour the auction ends. With considerations for
extension of delivery time if needed; (buyers will be notified
accordingly).
Buyers
are encouraged and should inspect there items within
48 hours of delivery. After 48 hours passes and no
disputes are filed the auction will be considered to be complete and
LiquidationTime will pay the seller. All associated fees will be
deducted as agreed upon.
No
disputes will be honored more than 48 hours after delivery has been
made.
Dispute
forms must be printed from the Liquidation Time website. They
must be filled out, signed, and faxed back to Liquidation Time’s
dispute department. We will only accept the dispute form that
is provided by the dispute department.
Buyers
shall allow up to 10 days for LiquidationTime.com to render a final
decision on any dispute filed with the Dispute Resolution Center. We
will always do our best to maintain an open and professional
dialogue with the buyer and to do whatever we can to resolve the
dispute. All disputes must be supported with all possible
documentation including pictures, statements and samples of the
defective product(s).
The
dispute will be resolved based on the policies
of LiquidataionTime.com. LiquidationTime.com is not
responsible for damages caused by the decisions of the
LiquidationTime.com dispute resolution center. Should either
party (buyer or seller) not be happy with the outcome of the
dispute resolution they are free to consult legal advice and pursue
their claim through criminal or civil action. Liquidation time will
only release a user’s information to authorized parties such as law
enforcement agencies and court officers and then only with a subpoena
or court order.

Hold harmless and indemnity
|
You agree to
hold harmless and indemnify (LiquidationTime.com) from and against any
third party claim arising from or in any way related to your use of
(LiquidationTime.com) services, including any liability or expense
arising from all claims, losses, damages (actual and consequential),
suits, judgments, litigation costs and attorneys' fees, of every kind
and nature. In such a case, (LiquidationTime.com) will provide you with
written notice of such claim, suit or action.
Under no circumstances will we be liable to you for any indirect,
incidental, consequential, special or exemplary damages arising out of
or in connection with use of (LiquidationTime.com) services, whether or
not (LiquidationTime.com) had been advised of the possibility of such
damages. Such limitation of liability shall apply (l) whether the
damages arise from use or misuse of and reliance on
(LiquidationTime.com), from inability to use (LiquidationTime.com), or
from the interruption, suspension, or termination of
(LiquidationTime.com), (including such damages incurred by third
parties) and (ll) not withstanding any failure of essential purpose of
any limited remedy and to the fullest extent permitted by law. Some
states do not allow the exclusion or limitation of incidental or
consequential damages, so the above limitation and exclusions may not
apply to you. Under no circumstances shall (LiquidationTime.com) be
liable to you for any amount exceeding one thousand dollars ($1000.00)

Term and termination and/or
Access Restriction

These Terms of Service will apply to your use of (LiquidationTime.com).
At any time, you can terminate your account which will remove your
profile from view.
(LiquidationTime.com) reserves the right, in its sole discretion and
judgment and without liability of any kind to you, to terminate your
access to the Site for any reason, at any time, without notice. Once
your membership terminates, you will have no right to use the
(LiquidationTime.com) service. Our proprietary rights, disclaimer of
warranties, indemnities, limitations of liability and miscellaneous
provisions shall survive any termination of your membership.
Notices (LiquidationTime.com) may provide you with notices regarding
the (LiquidationTime.com) services or these terms and conditions of use
by regular mail, email, or postings to this Web site.
Without limiting other remedies, (LiquidationTime) may immediately
issue a warning, temporarily suspend, indefinitely suspend or terminate
your membership and refuse to provide our services to you: (a) if you
breach this Agreement or the documents it incorporates by reference;
(b) if (LiquidationTime) or any Certified Merchant is unable to verify
or authenticate any information you provide to LiquidationTime, or (c)
if LiquidationTime believes that your actions may cause legal liability
for you, other LiquidationTime users or LiquidationTime itself.
These terms and conditions of use will be governed by and construed in
accordance with the laws of the Commonwealth of Pennsylvania, without
giving effect to its conflict of law provisions or your actual state or
country of residence. The parties agree to submit to the personal and
exclusive jurisdiction of the courts located in Philadelphia County,
Pennsylvania. If for any reason a court of competent jurisdiction finds
any provision or portion of the terms and conditions of use to be
unenforceable, the remainder of the terms and conditions of use will
continue in full force and effect. You shall not assign these terms and
conditions of use or assign any rights or delegate any obligations
hereunder, in whole or in part, whether voluntarily or by operation of
law, without our prior written consent. Any such purported assignment
or delegation will be null and void and of no force or effect.
Without limiting the foregoing, under no circumstances shall
(LiquidationTime.com) be held liable for any delay or failure in
performance resulting directly or indirectly from acts of nature,
forces, or causes beyond its reasonable control, including, without
limitation, Internet failures, computer equipment failures,
telecommunication equipment failures, other equipment failures,
electrical power failures, strikes, labor disputes, riots,
insurrections, civil disturbances, shortages of labor or materials,
fires, floods, storms, explosions, acts of God, war, governmental
actions, orders of domestic or foreign courts or tribunals,
non-performance of third parties, or loss of or fluctuations in heat,
light, or air conditioning.
These terms and conditions of use constitute the entire agreement
between you and (LiquidationTime.com) with respect to the subject
matter hereof and supersede and replaces all prior or contemporaneous
understandings or agreements, written or oral, regarding such subject
matter. Any waiver of any provision of the terms and conditions of use
by a party will be effective only if in writing and signed by a party.
All trademarks
used on this site are trademarks or registered trademarks of
(LiquidationTime.com) or other third parties. The copying,
redistribution, use or publication by you of any such marks is strictly
prohibited.
You may not use
the Site in any manner that could damage, disable, overburden, or
impair this site or any network associated with this site or interfere
with any other parties use or enjoyment of this site. You may not
attempt to gain unauthorized access of this site, any computer system
or network connected to or affiliated with this site through hacking,
password mining or any other means. You may not attempt to obtain any
materials or information through any means not intentionally made
available at this site.

information is believed to be accurate as of the date prepared, we
disclaim any duty or obligation to update this information or any press
releases. Information about companies other than ours contained in the
press release or otherwise should not be relied upon as being provided
by or endorsed by us.
LiquidationTime is not an Auctioneer. Although LiquidationTime is
commonly referred to as an online auction web site, it is important to
realize that we are not a traditional "auctioneer." Instead, the site
acts as a venue to allow certain persons to sell and buy certain
products at anytime, from anywhere, in a variety of pricing formats, an
auction-style format commonly referred to as "online auctions" or
"auctions.” Our services include, but are not limited to: protecting
you from fraudulent buyers or sellers, delivering approved certified
buyers, to maintain a platform with the highest level of data privacy
and security, continuously increase customer demand for your products,
to provide additional customer support services, provide you with
communication tools, payment collection, arrange shipping, and many
more other services.
LiquidationTime.com is only a venue for members that are considered
(Registered Users) to smooth the process of transactions between buyer
and seller. It is understood and agreed that LiquidationTime is not a
broker, trader, seller or agent and has no duty with users in regard to
transactions posted on its website. LiquidationTime.com does
not guarantee the quality, safety, condition, or ownership of the
belongings advertised for sale on its site and does not guarantee the
exactness of the information provided in the description of belongings
advertised for sale on its site. LiquidationTime.com does not guarantee
any individual seller or buyer's ability to complete transactions using
our online service and makes no representation regarding the identity,
creditworthiness, or performance of the buyers and sellers.
LiquidationTime will only keep transaction history and closed auctions
listings for a maximum of 30 days. All auction transactions will
automatically be removed after this time period. LiquidationTime will
not be responsible for any transaction history older than 30 days. All
customers are urged to keep a personal transaction history of all
auctions in which they take part in.
Joining our site is free. However, bidding on items at
(LiquidationTime.com) is associated with fees for both buyers and
sellers. We do charge fees for listing items for sale through our Site
and when you list an item you have the opportunity to review and accept
the fees that you will be charged. Our fees are available and are
incorporated into this agreement by reference.
We may change
our Fees and Credit Policy, and the fees for our services from time to
time. Our changes to the policy are effective after we provide you with
at least fourteen (14) days’ notice of the changes by posting the
changes on the Site. However, we may choose to temporarily change our
Fees and Credit Policy and the fees for our services for promotional
events (for example, free listing days) and such changes are effective
when we post the temporary promotional event on the Site. We may, in
our sole discretion, change some or all of our services at any time. In
the event we introduce a new service, the fees for that service are
effective at the launch of the service. Unless otherwise stated, all
fees are quoted in U.S. Dollars. You are responsible for paying all
fees associated with using our service and the site and all applicable
taxes.
The
buyer will pay as explained below:
Total dollar amount of winning bid
Plus 5% of the total
winning bid
Plus All shipping
charges
Plus Any pre-agreed
upon fees
The seller will
only be paid the total dollar amount of winning bid.
LiquidationTime.com will take its fees of 5% of the total winning bid
and all applicable shipping charges as charged to the buyer unless
other wise stated in the auction such as free shipping, or seller
offers the shipping costs as part of the package.
If you submit a
bid, you are in a legally binding contract and you must complete the
purchase. If you place a bid, make sure you have full intentions of
paying for the item(s) you bid on. By bidding, the buyer agrees to and
understands that all associated fees and all conditions such as
shipment fees are the buyer’s full responsibility. The buyer will be
charged a premium fee as stated in the auction. The buyer, by bidding
on any auction, is demonstrating buyer's intentions and financial
capability to purchase these assets.
Sellers will hold full and single responsibility for the precision,
wholeness, and legitimacy of all the information posted in their
auctions for sale. Sellers posting Items for sale on
(LiquidationTime.com) correspond to and affirm that they are the
legitimate owners of the items which they list. Each seller assumes
full responsibility for all aspects of their product listings including
product descriptions, identification of quantities, and any additional
information the seller uses in the auction to sell his or her products.
Sellers have to agree that LiquidationTime.com, at its single caution,
can act with full rights and legality that it has judged to be
necessary. LiquidationTime may at any time review, edit or
remove any listing information provided by sellers
which may not comply with our rules and regulations. LiquidationTime
reserves the right, to immediately halt any auction or product sale,
prevent or restrict access to the site or services and take any other
action in case of technical problems, objectionable material,
inaccurate listings, inappropriately categorized items, auction
inaccuracies, product inaccuracies, unlawful items, items, procedures,
or actions otherwise prohibited by the procedures and guidelines
contained on the Site and to correct any inaccurate listing, auction
inaccuracies, product inaccuracies, inappropriately categorized items
or technical problems on the site or for any other reason in the sole
and absolute discretion of LiquidationTime, it is felt that a buyer,
seller, LiquidationTime.com or someone else may be injured or adversely
affected by the postings, auction, etc.
Merchandise MUST be available for pickup within a time limit of 3-5
business days after the auction has closed. If after the auction
closes, the merchandise is not available for pick-up within 3-5
business days, the seller is responsible for any and all penalties
and/or damages. There are NO EXCEPTIONS. Merchants who do not
meet Liquidation Time’s service standards will not be permitted to list
items on the site.
Merchants providing false, inaccurate, or misleading information on
their postings, selling fraudulent, counterfeit or stolen items,
infringing on any third party's copyright, patent, trademark, trade
secret or other proprietary rights or rights of publicity or privacy,
or violating any laws, statutes, or ordinances will be banned from
LiquidationTime.com
By submitting
material to LiquidationTime.com the seller agrees to be held solely
liable for any damage resulting from any infringement of copyrights,
proprietary rights, or any other harm resulting from such a submission
and agrees to pay for all legal fees, expenses and other cost incurred
by LiquidationTime.com to defend or otherwise handle allegations
dealing with issues of this nature.
We will not
knowingly allow the use of our platform to sell illegal items of any
kind through LiquidationTime.com, including, without limitation to
stolen or misrepresented merchandise, counterfeit goods, drugs,
firearms, knock-off merchandise, pornographic material, multi-level
marketing products or any other items of questionable nature that in
the opinion of this company is unlawful.
This Site and Services may only be used for lawful purposes and in a
lawful manner. You must agree to comply with all applicable laws,
statutes, and regulations regarding use of the services, including, but
not limited to bidding and purchasing of items.
Upon posting belongings for sale, the seller represents, warrants, and
agrees that it is once and for all offering to sell the listed
belongings to any qualified Buyer who meets the requirements of the
auction’s terms for payment and shipping. Sellers agree to ship to the
highest bidder. Sellers must represent and warrant that he has legal
title to the offered belongings, and that those items are free of any
lien, security interest, leasehold interest, and/or co-ownership
interest.
Sellers warrant that he/she has not listed belongings to take over
rights, privileges, or activities that belong to somebody else or
violates (by all or by part), any third party's copyright, patent,
trademark, trade secret or other intellectual property or proprietary
rights.
Failure of the seller to complete the sale of an asset to a qualified
Buyer because of non-delivery or misrepresentation of the merchandise
or for any reason shall result in damages payable to the Company of up
to a maximum amount of $17,000. Such damage shall become immediately
due and payable by the Seller to the Company. Any and all
additional shipping costs incurred because of incorrect shipping
information and/or preparation is the sole responsibility of the seller
and the seller agrees to pay these costs.
Seller agrees to pay LiquidationTime a fee of 5% of the final auction
price. This fee will be deducted from the proceeds of the sale prior to
the seller receiving payment.
Seller Payments:
Sellers will be paid on a weekly basis. Every Friday, LiquidationTime will disburse payments to sellers whose transactions have been fully completed and closed. This means that at least 48 hours have passed after merchandise has been delivered and no complaints filed. If a delivery is made but the 48 hour time frame has not yet ended, then sellers’ payment (s) will be made the following Friday.
This new policy has been set to help our consumers in faster and more convenient transactions. Please remember that we are continuously working to improve the service with which we provide you.
We expressly
forbid the practice of "shill bidding" (i.e., casting bids in an
auction for the sole purpose of driving up the price of the merchandise
offered) Shill bidding is illegal and strictly forbidden on
LiquidationTime.com. Anyone found shill bidding will be suspended after
their first violation and permanently banned upon any subsequent
violation. All violations of law will be investigated and
reported to the appropriate authorities.
By bidding on
any auction, buyers warrant and agree that they have the full intention
and financial capability to purchase the items bid upon. Once a bid is
posted by the buyer, buyer may not retract, amend or modify their bid
without approval from LiquidationTime.com.
After an auction has closed in which a buyer has a winning bid, he/she
fully agree to comply with our terms. The Buyer is required
to make instant payment for the full and complete sum of the
transaction. This includes the affirmed shipping costs,
Buyer's Premium, and any other charges or taxes stated in our terms and
conditions or are otherwise applicable. Payment must be made via
payment methods provided by (LiquidationTime.com). These fees are due
no later than 2 business days after notification of winning the auction.
The buyer has a
maximum of two days to make full payment. If
(LiquidationTime.com) does not receive payment within these two
business days, the winning Buyer/bidder will be considered in evasion
of the bidding contract and shall be responsible for paying a
penalty. Our penalty for late payment is a fee of $200 or 15%
of the final auction price, whichever is larger. This total will be
charged to the credit card on file and is due immediately upon default
of the agreement. This applies to both sellers and buyers alike.
LiquidationTime recognizes the value of time invested by our customers
in operating their online business and seeks to reduce and/or eliminate
the problems associated with persons who are conducting their business
in other than a professional manner. The penalty fee goes towards
compensating the aggrieved party and to cover LiquidationTime's cost
associated with listing and monitoring the auctions.
Buyers
agree that if the charge took place and the payment did not go thru for
any reason, the buyer will still be responsible for the total due plus
any and all attorney fees, collection fees, and other associated costs
for attempting to collect the debt.
Buyers shall be held accountable for all costs.
If the buyer refuses the shipment once it has
arrived at the shipping address provided unless it is refused due to
damage to the shipment. These charges are to cover shipping
costs from seller to buyer and back. The Buyer is
responsible for any and all extra fees that may be added to
the charges for any handling or any special care
that is needed to handle such an event.
In the event of
extraordinary circumstances not within the control of our company,
LiquidationTime is entitled to cancel or delay an auction which may
cause delay or prevent the proper process of the auction or otherwise
prevents the auction from being conducted properly.
We,
LiquidationTime, have the full and legal right to cancel any auction
and/or a Bid, if we suspect that the bid was not submitted in good
faith and/or with intention to deceive and/or in any case where we
suspect illegal use of a credit card. In no event shall the
LiquidationTime site be held responsible for any purchases made by
illegal use of a credit card. Any illegal use of credit cards will be
investigated thoroughly and reported to the appropriate law enforcement
authorities.
Buyers are asked to:

Go
through the checklist carefully to prepare to bid.
· A buyer should
not bid on identical items in different listings if they are just
looking to buy one. If you win both auctions, you will be obligated to
buy them both! Each bid you place enters you into a binding contract.
·
If
you are outbid on one item, wait until that auction has ended before
placing a bid on an equivalent item. If the bidder who outbid you
retracts his/her bid or becomes unregistered before the auction ends,
your bid may become the winning bid. Consider placing the identical
item on your list of items you're watching in my auctions.
The
above shall not prejudice any right and/or claim the Company may have
towards a third party.
In
the event of a failure by the seller to ship in accordance with LT
policy or a failure by the buyer to pay the seller in accordance with
LT policy, the defaulting party agrees to pay the fee of two-hundred
$200.00 dollars to LiquidationTime.com. This payment to be immediately
billed to the defaulting parties credit card.
In
the event that the defaulting parties credit does not allow the
billing, the defaulting party hereby agrees to pay the total due in
full by certified check, cash, money order or other credit card within
72 hours.
Failure
to do so will result in immediate suspension form liquidation time and
the defaulting party shall be required to pay all fees due to
LiquidationTime.com or any subsequent holder of a promissory note, plus
interest, and other fees which may become due. The defaulting party
further agrees to pay all attorney fees and reasonable collection costs
and other charges necessary for the collection of any amount not paid
when due. All parties hereby state that they have personally read the
terms and conditions specified herein and agree to its terms.
LiquidationTime will pay the injured party (buyer or seller) $50.00
dollars once this penalty has been collected from the defaulting party.
The penalty will be collected from the defaulting party (buyer or
seller) who did not uphold their agreement with LiquidationTime.com as
set forth in the terms and conditions of this website for submitting
payment as a buyer, or for failure to ship the merchandise as a
seller.
Defaulting parties failing to comply with these terms and conditions
will be notified by email. Failure to respond within 72 hours
will result in your case being referred to our collection department
and ultimately to a third party collection agency for action.
By agreeing to these terms and conditions you authorize
LiquidationTime.com to release your information to a third party
collection agent for purposes of collecting any and all unpaid fees,
interest, damages etc.
If you submit a testimonial to us about how the
Site has worked for you, such testimonial will be deemed not to be
confidential or secret, and may be used by us in any manner. By
submitting or sending a testimonial to us, you: (i) represent and
warrant that the testimonial is original to you, that no other party
has any rights thereto, and that any "moral rights" in such testimonial
have been waived, and (ii) you grant us a royalty-free, unrestricted,
worldwide, perpetual, irrevocable, non-exclusive and fully
transferable, assignable and sub-licensable right and license to use,
reproduce, publish, distribute, display, translate, summarize, modify
and adapt such testimonial (in whole or part) and/or to incorporate it
in other works in any form, media, or technology now known or later
developed, in our sole discretion, with or without your name.
Defaulting
Party, Seller - is defined as a registered seller with
LiquidationTime.com who has failed to ship an order that has been
placed by a registered buyer and payment has been submitted but the
seller refuses to ship the order.
Defaulting Party, Buyer – is defined as a registered buyer with
LiquidationTime.com who has refused to submit full payment for an order
after having placed the order through LiquidationTime.com.
Details of Bids submitted by Participants are kept in strict
confidentiality until the closing of the Auction.
Only the Auditors and supervisors will be entitled to observe
the different Bids while an Auction is an Open Auction.
All Auctions
are under the supervision of an Auction supervisor.
All additional
and/or extraordinary taxes and/or payments according to law that apply
to an item offered in an Auction not expressly defined in this Users
Agreement as being paid by LiquidationTime shall be the responsibility
of the participant.
The headings of
this Agreement are for convenience only and should not be used for the
purposes of interpretation of the agreement.
LiquidationTime will not be held responsible for the use of bid details
and/or other information given by participants when submitting Bids.
Members are encouraged to seek information from the manufacturer and/or
service provider for the detailed specifications of the products and/or
services offered through the Auctions.
No provision of
this agreement may be waived, except by written agreement signed by
both parties.
This Agreement shall be binding upon all parties hereto, as well as
their agents, servants, successors, assignees, licensees and
transferees.
LiquidationTime and LiquidationTime Inc and LiquidationTime.com are all
leading to the same group.
